Asbestos management

At least 3500 people in Great Britain die each year from mesothelioma and asbestos related lung cancer as a result of past exposure to asbestos. Annual numbers of deaths are predicted to go on rising.

Regulation 4 of the Control of Asbestos Regulations 2006 requires the Dutyholder for every non-domestic building to assess where asbestos is or is liable to be present and develop and implement an asbestos management plan for that building, updating it where necessary.

A common misapprehension is that once a Dutyholder has had an asbestos survey carried out at their premises this ensures compliance with the regulations. An asbestos survey alone is not sufficient to comply with the regulations. In the majority of cases an asbestos survey will be required to locate and assess all the asbestos containing materials (ACMs) present in the building. The register within the asbestos survey should form the basis of the Asbestos Management Plan.

It is also understood that the Health and Safety Executive will increasingly undertake checks that non-domestic properties have an asbestos management plan whereby the results of an assessment are incorporated into an Asbestos Management Plan.

Under the Control of Asbestos Regulations 2006 and the Construction (Design Management) Regulations 1994 any property undergoing demolition or extensive refurbishment will require a Refurbishment / Demolition Asbestos Survey. This survey is designed to be used as a basis for tendering the removal of ACMs from the building prior to demolition or major refurbishment.
